Guns, Ammunition and Hunting Supplies to Get Weekend Sales Tax-Holiday

Buy Firearms, Ammo and Hunting Supplies Tax Free September 4-6

Louisiana Firearm, Gun and Ammunition Tax HolidayThe first ever "Louisiana Second Amendment Weekend Sales Tax Holiday" kicks off at 12:01 a.m. on Friday September 4 and runs through midnight Sunday, September 6.  The program exempts hunters, gun-owners and firearms enthusiasts from having to pay all state and local sales taxes on purchases of all firearms, ammunition and related hunting supplies.

Act 453 of the 2009 general legislative session provides a full and complete exemption from state and local sales and use taxes on purchases of firearms, ammunition and hunting supplies on the first Friday through Sunday of each September.

All consumer purchases of guns of all sorts, ammunition including all calibers of bullets and shells for every guage of shotgun are exempt from the taxes, as are various hunting supplies that do not qualify as actual firearms or ammunition.

Firearms eligible for the sales tax exemption include all makes and models of shotguns, rifles, pistols, revolvers and other handguns.  Basically, between Friday and Sunday consumers will be fully exempt from any and all state and local taxes normally applied to guns and ammunotion that can be legally bought and sold in Louisiana.

A variety of other hunting-related items also qualify for the weekend tax holiday.  These include the following:

  • All ammunition intended to be fired from a gun or firearm is exempt from the tax.
  • Archery supplies intended for use with hunting are exempt, including bows, crossbows, arrows and other bow-hunting supplies.
  • Corn, grain and other animal feed that is manufactured and marketed for luring game for hunting purposes.
  • Hunting apparel and clothing such as safety gear, camoflauge clothing, thermal gear, boots, shoes and other clothing and attire manufactured and marketed for hunting purposes.
  • Binoculars, knives and other various tools used primarily for purposes associated with hunting.
  • Duck blinds, tree stands and decoys.
  • Accessories designed to be used for hunting or in association with other products used for hunting.
  • Optics such as rifle scopes and shooting glasses
  • Other miscellaneous products and hunting-related gear not mentioned on this list.

Here is the official statement from the Louisiana Department of Revenue detailing eligibility requirements and conditions for the sales tax holiday program:

The state and local sales and use tax exemption applies to an individual’s purchase of firearms, ammunition and hunting supplies. The sales and use tax exemption is not available for business purchases. Consumer purchases do not include the purchase of animals for hunting.

LDR has published a rule that details which consumer purchases are eligible for state and local sales and use tax exemption during the holiday and when these purchases are to occur. The rule (LAC 61:I.4425) is available on the Louisiana Administrative Code: Emergency Rules page at www.revenue.louisiana.gov.

During the Annual Louisiana Second Amendment Weekend Sales Tax Holiday, a consumer’s purchase will be eligible for the state and local sales and use tax exemption, under any of the following conditions:

1. Title to or possession of firearms, ammunition and hunting supplies is transferred from a selling dealer to a purchaser.

2. A customer selects an eligible item from the selling dealer's inventory for layaway that is physically set aside in the selling dealer's inventory for future delivery to that customer.

3. The customer makes final payment and withdraws an item from layaway that might have been placed on layaway prior to the Annual Louisiana Second Amendment Weekend Sales Tax Holiday.

4. The customer orders and pays for an eligible item and the selling dealer accepts the order for immediate shipment, even if delivery is made after the time period provided for in LAC 61:I4425.A, provided that the customer has not requested delayed shipment.

Editor's Note: Kudos to the Louisiana State Legislature and Governor Bobby Jindal for enacting this legislation, standing up for the Second Amendment and gun owners' rights at a time when both are under attack from special interest factions as well as the American government.

This author and this website would like to see more states follow Governor Jindal's lead and declare periodic sales tax holidays on consumer purchases of guns, ammunition and other hunting and shooting-related goods.

God bless America and God bless the Second Amendment!
